Yahoo!7 It Takes Two Promotion - Terms of Entry
The Yahoo!7 It Takes Two Promotion (“Promotion”) is conducted by Yahoo!7 Pty Ltd (ABN 60 089 187 100) of Pier 8/9 Hickson Road, Millers Point, New South Wales 2000 (“Yahoo!7”), and by entering you agree to the following terms.
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia .
2.2 Employees and their immediate families of the Promoter, Seven Network (Operations) Limited & affiliates, m.Net Corporation Ltd, Intel Pty Ltd and their respective related bodies corporate, associated agencies and companies are not eligible to enter.
3. HOW TO ENTER
3.1 The Promotion commences on Tuesday 12th June 2007 at 19.30 (AEST) and concludes on Wednesday 4th July 2007 at 09:00 (AEST). (“the Promotion Period”).
3.2 Viewers must watch It Takes Two (“the Program”) on Tuesday 12 June 2007, Tuesday 19 June 2007, Tuesday 26 June 2007 and Tuesday 3 July 2007 when there will be a Promotion segment broadcast during the Program (and if programming changes require that the Program will be broadcast on another date, viewers will be advised of alternative entry procedure).
3.3 In order to enter, you must:
a) go to http://www.yahoo7.com.au/ittakestwo and register your first name, last name, postcode, state, email address, daytime phone number, mobile number and confirmation of ability to attend in the online form provided. Non compulsory details include street address.
b) be able to travel and attend the Program Grand Final event in Melbourne on the dates and times specified in clause 4.1.
3.4 Only one entry per person per day will be accepted. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process. No scripting is allowed for online entries and will be deemed invalid.
3.5 Entries must be received by 09.00 (AEST) on Wednesday 4th July 2007. The time of entry will be the time at which the completed online entry form is received by the Promotion’s online database. Online entrants will be presented with a confirmation page once the completed email entry is submitted by the entrant.
4 PRIZES
4.1 There will be one major winner who will win the prize package as set out below.

Total maximum prize value is up to $24,181 (including GST). Prize values are based upon the recommended retail prices as at Tuesday 5 June 2007 The Promoter accepts no responsibility for any change in prize value between that date and the travel date.
4.3 If the winner is from Victoria they will receive 1 night accommodation in a standard twin share room at the Crown Promenade, South Bank Melbourne, two tickets to the Program Grand Final in Melbourne and the follow up story in an online feature on the Promoter’s website. Airfares will not be included and cannot be redeemed for cash or other goods or services.
4.4 Prizes are not transferable and cannot be redeemed for cash or other goods or services and cannot be taken in parts. Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.
4.5 The winner (and their travelling companion) is responsible for all other expenses including additional spending money, meals, drinks, mini-bar, transfers, room service, telephone calls, activities, airport taxes (including departure taxes),laundry charges, tolls, activities, incidentals, taxes, fuel surcharges, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs. Travel insurance is highly recommended.
4.6 Should the Program Grand Final be cancelled or postponed due to unforeseen circumstances or reasons beyond the control of the Promoter, the Promoter may at its discretion vary or amend prizes so as to provide reasonable alternative prizes and the winners agree that no liability shall attach to the Promoter or parties connected to the Promoter as a result.
4.7 The winner and their travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Canberra, Hobart, Adelaide, Perth, Darwin or Brisbane). Tickets will not be exchanged for another destination.
4.8 Travel must be redeemed and completed in line with the confirmed Program Grand Final in Melbourne.
4.9 Air tickets are available on the regular scheduled services of the airline. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available on the travel prize and the winner and their traveling companion cannot upgrade any travel prize using Frequent Flyer points.
4.10 A credit card imprint or cash deposit may be required from the winners at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
4.11 The Promoter makes no guarantee that the celebrities and/or production staff of the Program will be present during the visit. Even if those people are present, the winner will not necessarily meet with any of them. Travel must be taken to coincide with the timing of the grand final. While at the studios, the winner must abide by, and ensure his or her companion abide by all reasonable requests of the program producer. Failure to comply may result in immediate and unconditional removal of the winner from the premises. Photographs will be allowed only at the discretion of the program producers and the celebrity.
In participating in the prize, the winner and traveling companion agree to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winner (and their companion) grant the promoter a perpetual exclusive licence to use such footage and photographs in all media worldwide and the winner (and their companion) will not be entitled to any fee for such use.
4.12 The winner agrees that they will not (and will ensure that their companion does not) sell or otherwise provide their story and/or photographs to any media or other organisation.
4.13 All entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter. If a winner of the prize is under the age of 18 as at the date of the draw, an adult must accompany the minor in the participation of the prize. Children under the age of 14 years are not permitted to attend the Program Grand Final.

5. HOW TO WIN
5.1 Each entrant who has entered the Promotion over the duration of the Promotional Period in accordance with clause 3.3 (“Qualifying Entrant”) will be entered into the draw. There will be one (1) winner drawn from the national pool of Qualifying Entrants. The draw will take place at m.Net Corporation, Level 2, 8 Leigh St, Adelaide SA, 5000 on Wednesday 4th July 2007 at 13.00 (AEST).
5.2 The prize winner will be notified by telephone call within 2 working days of the draw and a letter advising the winner of their prize will also be posted. The winner will be published in the Public Notices section of The Australian newspaper on Monday 9th July 2007, and on the website at http://www.yahoo7.com.au/ittakestwo.
5.3 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.4 It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements.
5.5 It is a condition of accepting the prize that the winner (and any companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
5.6 If the original winner is drawn from SA and has not been able to be contacted by The Promoter prior to 17.00 (AEST) on Thursday 5 July 2007 or is not able to travel on the nominated dates, the Promoter will arrange the winner’s trip to Melbourne on another date, with all the other prize inclusions (airfares and accommodation) excluding tickets to the Program Grand Final and the follow up story in an online feature on the Promoter’s website.
5.7 If the original winner is drawn from any other state except South Australia and has not been able to be contacted by 17.00 (AEST) on Thursday 5 July 2007 or has not contacted the Promoter to claim their prize, the initial winner’s prize will be forfeited, there will be a redraw at 17.30 (AEST) on Thursday 5 July 2007 at m.Net Corporation, Level 2, 8 Leigh Street ADELAIDE SA 5000 and the initial winner will have no claim. The winners’ details will be published in the Public Notices section of The Australian newspaper on Monday 9 July 2007.
6. NO LIABILITY
6.1 Any attempt made to deliberately damage any website or undermine the legitimate operation of the ‘Promotion is a violation of criminal and civil laws and should such an attempt be made, the Promoter reserves the right to seek damages or other remedies from any such contestant responsible for the attempt to the fullest extent permitted by law.
6.2 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to state government legislation.
6.3 The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available. An entry submitted to the Promotion may be declared invalid and cancelled by the Promoter if there is a technical malfunction of the Promotion or other related websites, including:
a) Incorrect allocation of Prizes or other damage caused during the Promotion , including but not limited to human error, operational errors, technical malfunction of any software, computer network, telephone network or other equipment’;
b) If there is tampering with the Promotion website or
c) Any condition beyond the control of the Promoter interferes with the Promotion .
6.4 If for any reason this Promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, to cancel, terminate, modify or suspend the promotion, subject to any written directions given under State Regulation.
6.5 Prizes will be sent within 28 days of the draw date and will be sent to the address given by you when you entered the Promotion. The Promoter, its partners and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.6 The Promoter, and all agencies and companies associated with the Promotion will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the draw;
b) whilst undertaking any travel won on or connected with their entry into the draw; or
c) in the participation in any prize;
d) due to the broadcast of any program relating to the Promotion or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
e) in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion;
f) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion
g) any damages resulting from your use or the inability to use the Promoter’s website
6.7 By entering the Promotion, you expressly understand and agree that:
a) your participation in the Promotion is at your sole risk.
b) the Promotion website is provided on an “as is” and “as available” basis.
6.8 Subject to any restrictions in law, the liability of the Promoter however arising, whether by breach of any condition or warranty implied by statute or of this agreement or of any duty of tort (including negligence) is limited to the total value of the Prizes.
7. PROMOTER’S DETAILS
7.1 Entry details remain the property of the Promoter. m.Net Corporation, on behalf of the Promoter and its related entities (“Seven”), is collecting the entrants’ personal information for the purpose of conducting and promoting this Promotion (including but not limited to determining and notifying winners), and, if you consent, for the purpose of the Promoter sending you promotional and direct marketing material in relation to products and services available through Seven, the Promoter and its business partners.
