Sony Playstation 3 ‘Drake’s Fortune’ Promotion

By entering the Sony PS3 Drake’s Fortune competition, you are agreeing to the following terms and conditions:

1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.

2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia over the age of 18 years where the Channel Seven broadcasting signal is received.
2.2 Employees and their immediate families of Seven Network (Operations) Limited & affiliates, m.Net Corporation, Sony Computer Entertainment Australia Pty Limited and their associated agencies and companies are not eligible to enter.

3. HOW TO ENTER
3.1 The competition commences on Thursday 6 December 2007 at 09.00 (AEDT) and concludes on Thursday 20 December 2007 at 23:59 (AEDT) (“the Competition Period”), however the dates and times for entry are detailed in the table below:

3.2 Between Thursday 6 December 2007 and Thursday 20 December 2007, a competition spot will air in commercial airtime on Seven. The competition spot will invite viewers to enter the competition. Viewers must register their entry by either:
a) sending a text message/SMS to 1977 4 777 with their name, suburb and state.
b) going online to yahoo7.com.au/drakesfortune
3.3 Only one entry per person per day will be accepted from entrants on-line. No scripting is allowed for online entries (which will be deemed invalid). SMS entrants can register as many times as they like.
3.4 Entries must be received by Thursday 20 December 2007 at 23:59 (AEDT) to be included in the draw. The time of entry will be the time the SMS message is received by the m.Net Corporation Ltd database or the online entry is received by Yahoo!7
3.5 For SMS entrants, each entry must be charged to a mobile account and SMS entries via the internet, computer generation or “scripting” are invalid and will not be accepted.
3.6 Each SMS entry will be charged at premium rate, namely $0.55 (including GST), which covers the entry and the reply message. SMS entrants will receive a reply message to their entry.
3.7 Entrants must be over the age of 18 years to enter and win.

4. PRIZES
4.1 There will be one (1) major prize winner and ten (10 runner-up prize winners drawn randomly from all valid entries received in accordance with clause 3 throughout the Competition period. Winners will receive the prize packages set out below:

4.2 Total prize value is $20,999.50
4.3 In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners grant the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
4.4 Winners should seek independent financial advice about any tax implications that may arise from the prize winnings. Prizes must be taken by the winner and cannot be transferred or exchanged.
4.5 The winners agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

5. HOW TO WIN
5.1 Each entrant who has entered the competition over the Competition Period and registered all details in accordance with clause 3 by entering online between the competition dates and times (AEDT) as stated in clause 3.1 (“Qualifying Entrant”) will be entered into the prize draw. The draw will take place at m.Net Corporation Ltd, Level 2, 8 Leigh Street, Adelaide SA 5000, on Friday 21 December 2007 @ 11:00 AEDT.
5.2 Winners will be notified by a phone call on the day of the draw, and a letter advising winners of their prize will also be posted. All winners’ names will be published in the Public Notes section of The Australian newspaper. Names of the winners will be published on Monday 31 December 2007.
5.3 The promoter’s decision is final and the promoter will not enter into correspondence regarding the result.
5.4 It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements.
5.5 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
5.6 Subject to State Legislation, an unclaimed prize draw will be held for all unclaimed prizes on Monday 12 March 2008 at 10:00 am AEDT at the premises of m.Net Corporation, Level 2, 8 Leigh Street Adelaide, SA 5000.
5.7 The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.

6. NO LIABILITY
6.1 The Seven Network (Operations) Ltd & affiliates, m.Net Corporation Ltd, Sony Computer Entertainment Australia Pty Limited and their associated agencies and companies associated with this promotion, will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.2 The Seven Network & affiliates, m.Net Corporation, Sony Computer Entertainment Australia Pty Limited and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the draw;
b) whilst undertaking any travel won on or connected with their entry into the draw; or
c) in the participation in any prize;
d) as a consequence of late, lost or misdirected mail or telephone malfunction;
e) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
f) due to circumstances outside the promoter’s reasonable control.
6.3 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any State Regulation.
6.4 Seven Network (Operations) Ltd & affiliates, m.Net Corporation Ltd, Sony Computer Entertainment Australia Pty Limited and their associated agencies and companies associated with this promotion assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.
6.5 Subject to State Regulation, if for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.
6.6 The promoter and all parties shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

7.2 The sponsor is Sony Computer Entertainment Australia Pty Limited (ABN 80 077 583 183) of 63 Ann Street Surry Hills NSW 2010.
7.3 Entry details remain the property of the Promoter. m.Net Corporation Pty Ltd , on behalf of Seven Network (Operations) Limited (ABN 65 052 845 262) and its related entities (“Seven”), is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and, if you consent, for the purpose of Seven sending you promotional and direct marketing material in relation to Seven’s programs and products and services available through Seven and its business partners. The entrant's personal information may be disclosed to m.Net Corporation for this purpose.
